City approves first reading of temporary marijuana ordinance

HURON — The Huron City Commission held the first reading on a temporary ordinance regarding the issuance of local medical cannabis establishment permits and/or licenses during Monday evening’s meeting. The commission passed the first reading.

The ordinance, No. 2224, has one actionable section, which reads as follows:

A medical cannabis establishment desiring to operate in the City of Huron shall be required to apply for a permit and/or license from the Municipality. Applications for a local permit and/or license to operate a medical cannabis establishment, as defined by SDCL 34-20G-1, shall not be accepted until the South Dakota Department of Health has promulgated regulations as required by SDCL 34-20G-72. Any application received prior to such regulations being promulgated shall be denied.

A temporary ordinance was chosen by the commission as the South Dakota Department of Health (DOH) has not presented counties and municipalities with definitions for licenses and permits at this time with the medical cannabis law set to take effect on July 1.

Assistant city engineer Dennis Bennett presented three bid/quote items to the commission. The first was a joint work order between Prostrollo’s and the city to add a reinforced concrete valley gutter between Waibel Drive Northeast and Prostrollo Motor Sales. The project is a 50% share for both parties at a total cost of $25,582.70. The commission approved the project as a change order to the city’s 2021 concrete project.

Bennett next presented the bid for bituminous road oil for chip sealing projects. The bid came from Jebro, Inc. of Sioux City, Iowa for $590.94 per ton. The city expects to purchase 208 ton, for a total cost of $122,083.52. This was approved.

The final bid/quote item presented by Bennett was a payment request from Asphalt Paving Materials Company for Bid No. 2021-15. As roughly 2/3 of street milling and overlay is completed, the payment of $46,572.66 to bring payment through the completed work was approved.

The commission approved an extension of its legal services agreement with Tucker Volesky for four years. Volesky thanked the city for the honor of continuing to serve in the role as the city’s attorney.

Commissioners also:
• Approved a raffle for the American Legion Post 7 during their state convention on June 24-27 at the Huron Event Center.

• Approved hire of Makenna Lonas for coach pitch/t-ball.
• Approved hire of Ulisas Ministro for coach pitch/t-ball.
• Approved termination of Shaun Ready from summer lifeguard position.

The commission voted unanimously to revise the job description for the Parks & Recreation department director. Human Resources director Nathan Hofer explained to the commission that the changes to the description will allow the city to attract and hire a person more fitting what the commission views as the role of the position.
